  • Late payments may incur interest charges at 1.5% per month
  • All payments must be made in the currency specified in the invoice

4.3 Taxes

All fees are exclusive of applicable taxes. You are responsible for paying all taxes associated with your use of our services.

4.4 Refunds

Refund policies will be specified in individual service agreements. Generally, custom development work is non-refundable once commenced.

5. Intellectual Property Rights

5.1 Company Intellectual Property

All content, software, designs, text, graphics, and other materials on our Website and in our services are owned by or licensed to YesTech Solutions (SL) Ltd and are protected by copyright, trademark, and other intellectual property laws.

5.2 Custom Development Work

Intellectual property rights in custom software and solutions developed for clients will be addressed in individual service agreements. Generally:

  • Client owns rights to custom business logic and data structures
  • YesTech retains rights to general methodologies and frameworks
  • Third-party components remain owned by their respective owners

5.3 Client Materials

You retain ownership of your data, content, and materials provided to us. You grant us a license to use such materials solely for the purpose of providing services to you.

6. Confidentiality

We understand the importance of confidentiality in business relationships. Both parties agree to:

  • Keep confidential all proprietary information shared during the course of business
  • Use confidential information solely for the purpose of providing/receiving services
  • Not disclose confidential information to third parties without prior written consent
  • Return or destroy confidential information upon request or termination of services

Separate Non-Disclosure Agreements may be executed for specific projects requiring enhanced confidentiality protection.

7. Service Level and Performance

7.1 Service Standards

We strive to provide high-quality services and will use commercially reasonable efforts to meet agreed-upon timelines and specifications.

7.2 Website Availability

We aim to maintain Website availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible.

7.3 Support Services

Support terms and response times will be specified in individual service agreements. General inquiries will be responded to within 2 business days.

8. Limitation of Liability

To the fullest extent permitted by law:

  • YesTech Solutions (SL) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount paid by you for services in the 12 months preceding the claim
  • We are not liable for delays or failures due to circumstances beyond our reasonable control
  • We make no warranties regarding third-party services or products
